THE WILL OF THOMAS BAILY (1694-1759)
Below is a word for word transcription taken from the original will held at he Suffolk Record Office in Ipswich.
This is the last will and
testament of me Thomas Baily of Theberton in the county of Suffolk, farmer.
Firstly I give and
bequeath unto Susan, my loving wife, the sum of sixty pounds of lawful British
money,
to be paid to her six weeks after my decease, in lieu of her thirds or
dower.
Also I give and devise
unto Thomas Baily, my son, and to his heirs forever,
all that my house wherein I
now dwell and where James Driver and Frances Mayhew, widow, now liveth,
together
with all the outhouses and land thereto belonging and that are now in my
occupation, situated in Theberton aforesaid.
He paying to Susan, my daughter,
the sum of forty pounds of lawful British money when she shall attain the age of
twenty and one years,
but if default of payment shall happen at the said time I
do hereby empower the said Susan, her heirs or assignees,
to seize all the said
houses and lands, and the same to hold and enjoy till full payment be made as
aforesaid,
together with the charges for seizing the same.
Also I give and devise
unto John Baily, my son, and to his heirs forever,
all those my houses and lands
lying and being in Snape in the said county of Suffolk.
Also I give and devise
unto Robert Baily, my son, and to his heirs forever,
all those my houses and
lands lying and being in Middleton with Hordley in the said county of Suffolk.
Also I give and devise
unto Jane Baily, my daughter, and to her heirs forever,
all that my house where
Thomas Hunt now lives and the yards thereto belonging and now in his occupation
situated in Theberton aforesaid,
together with free liberty to fetch water, from
my pump, necessary for their use at all times hereafter without paying anything
for the same.
Also I give and bequeath
unto Mary Baily, my daughter, the sum of like lawful British money.
All the rest, residue or
remainder of my estate that I shall leave at my decease,
I give towards payment
of my just debts, funeral charges and probate of this my will and the over plus
to be equally
parted between my three younger children Robert, Mary and Jane.
Above mentioned share and share alike, for and towards bringing them up.
Lastly I nominate and
appoint William King of Leiston in the said county of Suffolk, farmer,
sole
executor of this my will, allowing him reasonable charges for executing the care
and trust reposed in him.
Hereby revoking all former
wills made by me,
Signed, sealed, published
and declared by Thomas Baily, the testator as his last will and testament
in the
presence of us, who, in his presence and at his request, have subscribed our
names as witnesses hereto.
